Terms of service

THESE TERMS ARE SUBJECT TO ARBITRATION.

Last updated: November 5, 2026

Please read these Terms carefully. Section 17 requires you and us to resolve most disputes through binding individual arbitration instead of in court. It waives your right to a jury trial and to take part in a class action, and it explains how you can opt out within 30 days.

1. About these Terms

Horizon Health Shop (the “Store”) is operated by AnovaHealth LLC, a South Carolina limited liability company (“AnovaHealth,” “we,” “us” or “our”). These Terms of Service (the “Terms”) apply when you visit or use our website and online store, contact our team, or buy from us, including Subscribe & save orders.

Our Privacy policy, Refund policy and Subscription cancellation policy are part of these Terms. By using the Store or placing an order, you agree to these Terms. If you don't agree, please don't use the Store.

2. Who can use the Store

  • You must be at least 18 years old, or the age of majority where you live if that is older, and able to enter into a binding contract.
  • You agree to give us accurate, current information when you create an account or place an order, and to keep it up to date.
  • Products are sold for your personal use, as explained in section 5.

3. Health information is not medical advice

  • Everything on the Store, including product descriptions, ingredient information, wellness focus pages, articles and answers from our team, is general information. It is not medical advice and does not replace a consultation with a qualified healthcare practitioner. Our team can help you compare products, but cannot diagnose, treat or prescribe.
  • Talk to your practitioner before starting any supplement, especially if you are pregnant or nursing, take medication, have a medical condition or are planning surgery. Stop using a product and contact your practitioner if you have an adverse reaction.
  • Never ignore professional medical advice or delay seeking it because of something you read on the Store. In an emergency, call 911.
  • Statements about dietary supplements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure or prevent any disease.
  • Results vary from person to person, and we don't promise any particular result.

4. Products and product information

  • Third-party brands: the products we sell are made by other companies. We are a retailer, not the manufacturer. Each brand is responsible for how its products are formulated, made and labeled.
  • Labels come first: product descriptions, Supplement Facts, ingredient lists, directions and images on the Store are based on information from the brands. Brands sometimes change formulas, labels or packaging, so the product you receive may differ slightly from what is shown. Always read the label, directions and warnings on the product before using it. If they differ from the Store, follow the label.
  • Allergies and sensitivities: check the label for allergens and other ingredients you need to avoid. Some products are made in facilities that also handle common allergens.
  • Accuracy: we work to keep product information accurate, complete and current, but errors can happen and we don't guarantee that every detail on the Store is correct.
  • Practitioner-grade formulas: many products we carry are professional formulas meant to be used with the guidance of a healthcare practitioner.
  • Temperature-sensitive products: products marked “Ships cold” are packed to stay cool in transit. Bring them inside promptly and store them as the label directs.
  • Recalls: if a brand recalls a product you bought from us, we will make reasonable efforts to contact you using the details on your order and to follow the brand's instructions.

5. Orders, pricing and payment

  • Accepting orders: your order is an offer to buy. Our order confirmation email confirms that we received it. We accept your order when we ship it.
  • Our right to refuse or limit orders: we may refuse or cancel any order, or limit quantities per order, customer, household or address. This includes orders that appear to be for resale or that may be fraudulent. If we cancel an order after you are charged, we refund you in full.
  • Not for resale: products are sold for personal use only and may not be resold. Many of the brands we carry require this of their retailers.
  • Prices: prices are in US dollars and can change at any time. They don't include tax or shipping unless we say so. Changes don't affect orders we have already accepted. Subscription price changes follow section 6.
  • Errors and availability: if a product is listed at the wrong price or with wrong information, we may cancel orders for it, even after you receive a confirmation, and refund you in full. Products can sell out or be discontinued at any time.
  • Payment: you authorize us and our payment processors to charge your payment method for your order, including tax and shipping. You confirm that you are allowed to use that payment method. We collect sales tax where the law requires it.
  • Promotions: discount codes and promotions are subject to the terms shown with them. Unless stated otherwise, they have no cash value, can't be combined, can't be applied to past orders, and may end at any time.

6. Subscribe & save

Some products can be bought with Subscribe & save, a subscription that renews automatically. When you choose Subscribe & save and complete checkout, you agree that we will charge your saved payment method for each order on the schedule shown at checkout, at the subscription price plus any applicable tax and shipping, until you cancel. The main terms are:

  • Schedule: a new order is charged and shipped every month until you skip, pause or cancel.
  • Savings: each subscription order is 10% off the product's regular price.
  • Reminders: we email you 3 days before every subscription charge, with a link to skip, pause or cancel.
  • Price changes: if your subscription price changes, we email you at least 7 and no more than 30 days before the new price applies, with instructions on how to cancel.
  • Managing and cancelling: you can skip, pause or cancel at any time in your account, from any subscription email, or by contacting us, with no fees and no minimum number of orders. To avoid your next charge, cancel before the next order date shown in your account.
  • Failed payments: if a payment doesn't go through, we email you and try again up to 3 times, about a week apart. If the last attempt fails, we pause the subscription and email you. You can update your payment method and resume it from your account.
  • Orders already charged: cancelling stops future orders. An order that has already been charged can be cancelled if it hasn't shipped, or returned under our Refund policy.

The full terms are in our Subscription cancellation policy. If that policy and these Terms differ on a subscription matter, the Subscription cancellation policy applies.

7. Shipping and delivery

  • We ship to the destinations offered at checkout. Shipping costs, delivery options and any free-shipping threshold are shown at checkout.
  • Orders placed by 6:00 pm ET, Monday to Friday, usually ship the same business day. Delivery dates are carrier estimates and are not guaranteed.
  • Title to products passes to you when we hand your order to the carrier.
  • If your order is lost in transit, arrives damaged or isn't what you ordered, contact us within 30 days of delivery, or of the expected delivery date for a lost order. We will send a replacement or refund you. Damaged, defective and wrong items are covered by our Refund policy.
  • Please check your shipping address before you order. If an order is returned to us because the address was wrong or the package was refused, we may refund you less the shipping cost, or reship it at your cost.

8. Returns and refunds

Returns and refunds are governed by our Refund policy. In short, you can return any product, opened or unopened, within 30 days of delivery for a full refund of the product price. Return shipping is at your cost unless we made a mistake.

9. Your account

  • Keep your login details safe. You are responsible for activity in your account.
  • Tell us right away if you think someone else has used your account.
  • We may suspend or close an account that breaks these Terms or is used for fraud.

10. Reviews, questions and other content you share

  • When you post a review or send us a question, comment, photo or other content, you confirm that it is yours to share and that it is honest. You give us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display and adapt it, for example by shortening it, on the Store and in our marketing.
  • Reviews must reflect your own experience with the product. If you received anything for a review, such as a free product or a discount, say so in the review.
  • Don't claim that a product diagnoses, treats, cures or prevents a disease. Don't share anyone else's personal or health information. Don't post anything unlawful, misleading, abusive or promotional.
  • We may decline or remove content that doesn't follow these rules. We don't endorse the opinions in content that customers share.

11. Acceptable use

When using the Store, you agree not to:

  • break any law or anyone else's rights;
  • buy products for resale, or place orders using false information or someone else's payment method without permission;
  • use bots, scrapers or other automated tools to access the Store, collect data from it or place orders;
  • interfere with the Store's security or operation, or introduce viruses or other harmful code;
  • misuse discount codes or promotions;
  • impersonate anyone or misrepresent your connection with anyone.

12. Intellectual property

The Store and its content, including text, design, graphics and the Horizon Health Shop name and logo, belong to AnovaHealth or its licensors and are protected by law. You may use the Store for your own shopping and personal, non-commercial use. Brand names, logos and product images belong to their owners, and showing them on the Store doesn't mean a brand endorses us.

13. Third-party services and links

The Store is hosted by Shopify, and payments are handled by third-party payment processors. The Store may also link to other websites. We don't control third-party services or websites and aren't responsible for their content, policies or practices. Your use of them is subject to their own terms.

14. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE STORE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DON'T PROMISE THAT THE STORE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

PRODUCTS ARE COVERED ONLY BY ANY WARRANTY THAT THEIR MANUFACTURER PROVIDES. TO THE FULLEST EXTENT PERMITTED BY LAW, WE MAKE NO WARRANTIES OF OUR OWN AND DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. This doesn't affect your rights under our Refund policy. Some states don't allow these disclaimers, so some of them may not apply to you.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ANOVAHEALTH AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM THE STORE, THESE TERMS OR ANY PRODUCT, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE STORE, THESE TERMS OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT OR ORDER THAT THE CLAIM RELATES TO.

Nothing in these Terms limits liability that can't be limited by law, such as liability for fraud or for death or personal injury caused by our negligence. Some states don't allow these limits, so some of them may not apply to you.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless AnovaHealth and its members, managers, employees and agents from claims, losses and expenses, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Store, content you share, or your resale of products bought from us.

17. Dispute resolution and binding arbitration

17.1 Try to resolve it with us first. Most concerns can be solved quickly by contacting us. Before starting arbitration, you or we must send a written Notice of Dispute. Send yours by email to support@anovahealth.com with the subject “Notice of Dispute.” Include your name, contact details, order number if any, a description of the dispute and what you are asking for. We will send ours to the email address on your account or order. Both of us will try in good faith to resolve the dispute for 60 days after the notice is received. Deadlines for bringing claims are paused during those 60 days.

17.2 Agreement to arbitrate. If we can't resolve it, you and AnovaHealth agree that any dispute, claim or controversy arising out of or relating to these Terms, the Store, any product bought from us, or our relationship with you (a “Dispute”) will be resolved by binding individual arbitration, not in court. This includes Disputes that arose before you accepted these Terms. The arbitrator decides all questions about whether a Dispute must be arbitrated, except that a court decides questions about section 17.6 and section 17.7.

17.3 Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also ask a court to stop the infringement or misuse of intellectual property.

17.4 How arbitration works. The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, available at adr.org, and decided by a single arbitrator. For a claim of $10,000 or less, you may choose whether the arbitration is decided on written submissions only, by phone or video, or at an in-person hearing. Any in-person hearing will take place in the county where you live, unless we both agree otherwise. The arbitrator may award the same individual relief a court could, and the award may be entered in any court with jurisdiction.

17.5 Costs. Filing, administration and arbitrator fees are paid as set out in the AAA Consumer Arbitration Rules, which limit the fees a consumer pays. If you show the arbitrator that the cost of arbitration would be prohibitive compared with going to court, we will pay as much of it as the arbitrator finds necessary to prevent that. Each of us pays our own attorneys' fees, unless the law or the AAA rules allow the arbitrator to award them.

17.6 Individual claims only, and no jury trial. You and AnovaHealth may bring claims against each other only individually, not as a plaintiff or class member in any class, collective, consolidated or representative action. The arbitrator may award relief only to the individual party and only as needed for that party's claim. YOU AND ANOVAHEALTH EACH GIVE UP THE RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION. If a court decides that this section can't be enforced for a particular claim or type of relief, that claim or relief will be decided by a court after the arbitration of any individual claims is finished, and the rest of section 17 still applies.

17.7 Many similar claims. If 25 or more similar demands for arbitration are filed against us by or with the help of the same law firm or organization, the AAA's supplementary rules for mass or multiple case filings will apply, and the demands may be administered in batches.

17.8 Your right to opt out. You can opt out of this arbitration agreement within 30 days after you first accept these Terms, for example by placing your first order or creating an account. Email support@anovahealth.com with the subject “Arbitration opt-out,” and include your name, email address and, if you have one, an order number. Opting out doesn't affect any other part of these Terms.

17.9 Changes to this section. If we change section 17, you can reject the change by emailing us within 30 days after it takes effect. The change won't apply to any Dispute for which a Notice of Dispute was sent before the change took effect.

17.10 Governing law for arbitration. This arbitration agreement involves interstate commerce and is governed by the Federal Arbitration Act. Section 17 continues to apply after your use of the Store ends.

18. Governing law and courts

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law rules, except that section 17 is governed by the Federal Arbitration Act. This doesn't take away any protection you have under the consumer protection laws of the state where you live. Any Dispute that isn't arbitrated, other than a small claims case, will be brought only in the state or federal courts located in South Carolina, and you and we agree to their jurisdiction.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we post the new version here and change the “Last updated” date, and we tell you about important changes by email or on the Store. Changes apply from the date they are posted. Orders you placed before a change are governed by the Terms in effect when you placed them. Continuing to use the Store after a change means you accept the updated Terms.

20. Ending your use of the Store

You can stop using the Store at any time and cancel any subscription as described in section 6. We may suspend or end your access to the Store if you break these Terms. Sections that by their nature should continue, including sections 3, 4, 10 and 12 to 21, continue to apply after your use ends.

21. General

  • Entire agreement: these Terms and the policies they include are the whole agreement between you and us about the Store.
  • Severability: if any part of these Terms can't be enforced, the rest stays in effect, subject to section 17.6.
  • No waiver: if we don't enforce a part of these Terms, we haven't given up the right to enforce it later.
  • Assignment: we may transfer these Terms, for example if our business is sold. You may not transfer them without our written consent.
  • Events beyond our control: we aren't responsible for delays or failures caused by events beyond our reasonable control, such as carrier delays, severe weather, natural disasters, supply shortages or internet outages.
  • Electronic communications: you agree that we may send you notices, agreements and other communications electronically, and that these meet any requirement that they be in writing.

22. Notice for California residents
